Agreement to Terms

By accessing or using the CurbScout.com website and related mobile applications (collectively, the "Site"), operated by CurbScout, LLC ("CurbScout," "we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these Terms, please do not use the Site.

Brokerage Relationship Acknowledgment

By registering for an account on this Site, you acknowledge that you are entering into a lawful broker-consumer relationship with CurbScout Group, Compass Real Estate, as defined by Texas law. This acknowledgment does not impose any financial obligation on you and does not create an exclusive representation agreement. You have no obligation to work with CurbScout or Compass Real Estate, and you may terminate your account at any time.

Any agreement creating a representation relationship or imposing a financial obligation must be established separately from these Terms of Use, must be prominently labeled as such, and may not be accepted solely by mouse click.

Permitted Use of Listing Data

By registering and accessing listing data on this Site, you agree to the following:

• All information you obtain from this Site is intended for your personal, non-commercial use only.
• You have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through this Site.
• You will not copy, redistribute, or retransmit any of the information provided except in connection with your consideration of the purchase or sale of an individual property.
• You acknowledge the Unlock MLS's ownership of, and the validity of Unlock MLS's copyright in, the MLS database and listing data displayed on this Site.

MLS Compliance and Access Authorization

You expressly authorize Unlock MLS, MLS Grid, other MLS Grid Participants, and their duly authorized representatives to access this Site for the purposes of verifying compliance with MLS rules and monitoring the display of Participants' listings.

Account Registration and Security

To access detailed listing information, including photos, prices, and sold home data, you must register for an account. By registering, you agree to:

• Provide your true name and a valid email address.
• Confirm your agreement to these Terms of Use via email verification.
• Maintain the security of your account credentials. You are responsible for all activity that occurs under your account.

CurbScout uses passwordless authentication to protect your account. You may sign in using a magic link sent to your verified email address or through Google OAuth (single sign-on). No passwords are stored by CurbScout. Each magic link is single-use, expires after 15 minutes, and generates a unique session token upon verification. Your login session expires after 7 days, at which point you must re-authenticate by requesting a new magic link or signing in again with Google. Each email address is associated with exactly one account.

We maintain a record of your name, email address, and account activity in accordance with MLS Grid VOW Rules. These records are retained for a minimum of 180 days after your most recent session expires.

Listing Data Accuracy and Disclaimer

The listing data displayed on this Site is supplied by the Unlock MLS as distributed by MLS Grid. This data is deemed reliable but is not guaranteed accurate by MLS Grid or Unlock MLS. CurbScout does not warrant or guarantee the accuracy, completeness, or timeliness of any listing information displayed on the Site.

Where CurbScout publishes content to augment MLS-sourced data, the source of such additional information will be clearly identified. If you believe any content on this Site is inaccurate, false, or misleading, please contact us at realtor@curbscout.com or 512-270-9966, and we will review and correct or remove the content as appropriate.

Listing Display

• Listings displayed on this Site identify the listing brokerage name, listing number, and listing status immediately adjacent to the property information.
• Listings are sourced from the Unlock MLS as distributed by MLS Grid.
• Some sellers have directed that their listings or property addresses not be displayed on the Internet. Such listings are excluded from this Site in accordance with MLS rules.
• Some listings may be excluded from this Site based on objective criteria such as geography, price range, or property type. If listings have been excluded, this Site will note: "Some listings have been excluded from this website."

Prohibited Activities

You agree not to:

• Use the Site or listing data for any commercial purpose, including but not limited to data mining, scraping, or systematic downloading of listing information.
• Attempt to access, search, or retrieve data from the Site through any automated means (including bots, crawlers, or scrapers) without our express written permission.
• Use the Site to compile data for use by any third party.
• Circumvent, disable, or interfere with any security features of the Site.
• Misrepresent your identity or your bona fide interest in real estate.
• Use the Site in any manner that violates applicable local, state, or federal law.

Intel Property

All content on this Site, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property of CurbScout, LLC, Unlock MLS, MLS Grid, or their respective content providers and is protected by United States and international copyright laws. The CurbScout name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CurbScout, LLC. You may not use such marks without our prior written permission.

Third-Party Links and Content

This Site may contain links to third-party websites, services, or content that are not owned or controlled by CurbScout. We are not responsible for the content, privacy policies, or practices of any third-party sites. You access third-party sites at your own risk.

Privacy Policy

By registering for an account and using this Site, you also agree to our Privacy Policy, which describes how we collect, use, and protect your personal information.

Limitation of Liability

To the fullest extent permitted by law, CurbScout, LLC, its officers, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including but not limited to reliance on listing data, loss of data, or interruption of service, even if CurbScout has been advised of the possibility of such damages.

CurbScout's total liability to you for any claims arising from your use of the Site shall not exceed the amount you have paid to CurbScout, if any, for access to the Site during the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless CurbScout, LLC, Compass Real Estate, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms of Use, or your violation of any rights of any third party.

Modification of Terms

CurbScout reserves the right to modify these Terms of Use at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

Termination

CurbScout may suspend or terminate your account and access to the Site at any time, with or without cause, and with or without notice. Upon termination, your right to use the Site ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas.
