Overview

CurbScout, LLC ("CurbScout," "we," "us," or "our") operates the website CurbScout.com and related mobile applications (collectively, the "Site"). CurbScout respects the intellectual property rights of others and expects our users to do the same.

This Site follows the safe harbor provisions of 17 U.S.C. § 512, otherwise known as the Digital Millennium Copyright Act (DMCA). In accordance with the DMCA, CurbScout will respond to valid written notifications of claimed copyright infringement.

Filing a DMCA Notice of Claimed Infringement

If you believe that your copyrighted work or other intellectual property has been infringed by content appearing on this Site, please provide all of the following information to the CurbScout Designated Copyright Agent listed below:

  1. A description of the copyrighted work or other intellectual property that you claim has been infringed.
  2. A description of where the material that you claim is infringing is located on the Site, including the specific URL(s) or a sufficiently detailed description to allow us to locate the material.
  3. Your name, mailing address, telephone number, and email address where we can contact you.
  4. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright or intellectual property owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf.
  6. Your physical or electronic signature.

Counter-Notification

If you believe that material you posted on the Site was removed or disabled as a result of a mistaken or misidentified DMCA notice, you may file a counter-notification with our Designated Copyright Agent. Your counter-notification must include:

  1. Identification of the material that was removed or disabled and the location where it appeared before removal.
  2. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, and telephone number.
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the Western District of Texas if your address is outside the United States) and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Your physical or electronic signature.

Repeat Infringers

In accordance with the DMCA, CurbScout will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

Important Notes

  • CurbScout may request additional information before removing any allegedly infringing material.
  • CurbScout may provide the alleged infringing party with your contact information so that person can respond to your claims.
  • Pursuant to 17 U.S.C. § 512(c)(2), notifications of claimed copyright infringement should be sent to CurbScout's Designated Agent listed below.
  • Please note: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorneys' fees.

All inquiries that do not follow the above procedures may not receive a response.
